Terms & Conditions of Sales
1. Purpose and scope
These General Terms and Conditions of Sale (GTC) define the rights and obligations of the parties in the context of remote booking of stays offered at the Mas d'Oliu gîte, via the website or a partner platform.
Any reservation implies full and complete acceptance of these General Terms and Conditions as well as the specific conditions of the reserved rate.
2. Nature of the rental
The rental is granted as a furnished seasonal rental , within the meaning of article L.324-1-1 of the Tourism Code.
The Client expressly acknowledges that:
- The accommodation is rented exclusively for temporary leisure housing use.
- The rental property does not constitute a primary or secondary residence.
- Any administrative, tax or personal domicile is strictly prohibited.
- The residential lease regime (law of July 6, 1989) is expressly excluded.
3. Description of the cottage
Detached house situated on private land, enclosed and secured by a gate, with a private swimming pool secured by an electric roller shutter.
Layout :
- Ground floor: living room, dining room, fully equipped kitchen, shower room with WC, laundry room
- First Floor: three bedrooms, a shower room with WC, a separate toilet
Maximum capacity allowed: 7 people, including children.
⚠️ Any occupancy beyond this capacity is strictly prohibited.
4. Booking and process
The Client selects the stay and acknowledges having read the nature, destination and terms and conditions before any booking.
The reservation becomes firm and final after:
- acceptance of these Terms and Conditions,
- the payment of the required deposit.
A summary acknowledgement of receipt is automatically sent by email.
5. Length of stay
- Arrival : from 5:00 PM
- Departure : before 10:00 AM
At the end of the stay, the Client must completely vacate the premises and return all means of access.
Occupancy beyond the scheduled time:
- A fixed allowance of €350 per day started
- Full retention of the security deposit
- Legal action possible
Prices are shown in euros, inclusive of all taxes, for the duration of the selected stay.
The price includes:
- water, electricity, air conditioning
- fiber internet access
- household linen (sheets, towels, dish towels)
- end-of-stay cleaning
7. Payment terms
- 50% deposit required at the time of booking
- Balance due no later than 60 days before arrival
- Payment by bank transfer or via partner platform
In accordance with Article L.Article 221-28 of the Consumer Code states that no right of withdrawal applies to accommodation services with a fixed date.
8. Cancellation Conditions
By the Client
- More than 60 days before arrival: full refund
- Between 59 and 31 days: deposit earned
- Less than 30 days: no refund
Failure to arrive within 24 hours of the arrival date = reservation cancelled, full amount due.
By the Owner
Cancellation by the Owner: full refund + compensation equivalent to that which would have been borne by the Client.
9. Security Deposit
Security deposit: €2,500 only via Swikly bank imprint , without immediate debit.
May be retained in the event of:
- damage or deterioration
- loss or misuse of equipment (keys, remote control, parasol, swimming pool, barbecue…)
- disrespectful behavior or nuisance
- refusal to vacate the premises at the scheduled time
The Client has 24 hours after arrival to report any problems via the Swikly snagging system.
10. Behavior – Neighborhood – Safety
The Client agrees to use the premises and equipment responsibly.
Obligations:
- close doors and windows
- use the parasol with caution in windy conditions.
- close the pool cover when you are away
Children are under the exclusive responsibility of the Client; adult supervision is mandatory.
Quiet environment: Any noisy, festive, indecent, or immoral behavior (music, drunkenness, nudity, etc.) will result in:
- immediate termination of stay
- full withholding of the security deposit
- Immediate eviction with intervention if necessary
Legal safeguards:
- use of the swimming pool is at the Client's own risk.
- the owner is not responsible for loss, theft or damage to personal belongings
11. Pets
Pets are only allowed if they are declared at the time of booking .
The Client is fully responsible for any damage or nuisance.
Failure to declare = flat-rate surcharge of €30 per animal, deducted from the security deposit.
Animal droppings must be collected.
12. Insurance
The Client is responsible for any damage and undertakes to take out holiday civil liability insurance.
13. Force majeure
Neither party is liable if force majeure prevents performance.
Amounts paid will be fully refunded in the event that the rental cannot be completed.
14. Personal data
Collection of data necessary for booking and stay, in compliance with the GDPR.
Rights of access, rectification and deletion are available from the Owner.
15. Applicable Law and Jurisdiction
Terms and conditions are subject to French law.
Disputes: French courts only.
